Native American Hiring Provision (NAHP)

The Native American Hiring Provision (NAHP) is a standardized contract clause applied to contracts when the project corridor is located on, partially on, or directly adjacent to reservation lands or lands that retain reservation status. The provision also applies to off-reservation projects if a Tribally owned trust parcel lies directly adjacent to the project’s right of way.

To the extent permitted by federal and Wisconsin law, the NAHP supports Tribal employment goals of Tribes.

The provision is designed to stimulate early and meaningful dialog between contractors doing business in Tribal communities and Tribal workforce development programs. It encourages Native American hiring opportunities through enhanced communications and reporting mechanisms.

This determination happens during the scoping process (project definition phase), and documentation is completed prior to the final scope certification. It identifies if the Native American Hiring Provision will be included in a project, as well as which Native American Tribes have land interests within the project.

The primary objective of the DBE program is to level the playing field by:

  • Engaging small businesses owned and controlled by socially and economically disadvantaged individuals in the bid letting process.
  • Providing fair and continuous opportunities to DBEs so they may compete for federally funded transportation contracts.
