On August 11, 2016, the Federal Transit Administration (FTA) published the Public Transportation Safety Program Final Rule, 49 CFR Part 670. The rule covers administration of the Public Transportation Safety Program authorized at 49 U.S.C. § 5329, including FTA’s authority to oversee and enforce transit safety. The rule also establishes FTA’s foundational safety policy, which supports a risk-based safety management system (SMS) for development and implementation of the National Safety Program. Under Part 670 and the National Public Transportation Safety Plan, the Wisconsin Department of Transportation (WisDOT) has different responsibilities depending on transit mode: Bus safety compliance corresponds with WisDOT’s general oversight, while rail transit safety has its own regulatory program.
